There being no objection, it was so ordered and the new title follows: HOUSE BILL NO. 229 am "An Act authorizing the Alaska Railroad Corporation to participate in a project consisting of the acquisition, construction, improvement, maintenance, equipping, or operation of real and personal property, including facilities and equipment, for the Kenai gasification project and Port MacKenzie rail link, authorizing the corporation to issue bonds to finance all or a portion of the project, and identifying these as bonds for an essential public and governmental purpose; and providing for an effective date. 2007-04-23 House Journal Page 0874 Amendment No. 2 was offered by Representative Gara: Page 4, line 4, following "this Act,": Insert "and compliance with the requirement of (b) of this section," Page 4, following line 23: Insert a new subsection to read: "(b) The Alaska Railroad Corporation may not issue bonds under the authorization and approval set out in this section unless the Department of Environmental Conservation certifies that the coal gasification and electrical power generation facility will be designed and operated in a manner that does not release more carbon dioxide into the atmosphere, per megawatt of power produced, than the average carbon dioxide released per megawatt during calendar year 2006 by the Beluga natural gas power plant, located on the western coast of Cook Inlet." Reletter the following subsections accordingly. Representative Gara moved and asked unanimous consent that Amendment No. 2 be adopted. Representative Kelly objected. The question being: "Shall Amendment No. 2 be adopted?"
